Right of first refusal of the municipality

Under certain conditions, the municipality is entitled to a right of first refusal in the purchase of land and real estate on the basis of the building code (§ 24 ff. BauGB NRW) and the monument protection law (§ 31 ff. DSchG NRW).

The land registry office may therefore only enter a change of ownership in the case of purchase agreements if it is provided with evidence of the non-existence or non-exercise of the pre-emptive right of the City of Hilden (declaration of waiver of pre-emptive right).

The certificate, which is subject to a fee, is issued on the basis of a written application, which is usually submitted by the notarizing notary's office.
